Demo platform terms of use

If you register for a demo account to trial CMC Markets trading platform, CMC Markets grants you a personal, non-exclusive, revocable and non-transferable licence, to access and make personal and non-commercial use of the demo platform for the limited purpose of trialling financial betting in accordance with these terms. No other rights are granted in respect of the platform.

You must not (unless these terms or CMC Markets state otherwise):

(a) copy, reproduce, or duplicate the platform or any content or data displayed on the website;

(b) permit other individuals to use the platform;

(c) link to the platform;

(d) modify, translate, reverse engineer, decompile, disassemble (except and solely to the extent applicable law expressly and specifically prohibits such restrictions), or create derivative works based on the platform or any of its contents or any content or data displayed on the website;

(e) modify the operation of the platform;

(f) re-distribute, re-sell, re-transmit, publish, sub-licence, disclose, display or make commercial use of the Platform or any content or data provided within the platform or website;

(g) download or copy account information other than if required to do so by an official body or for personal use;

(h) use data mining, robots or similar data gathering and extraction tools on the platform;

CMC Markets may indefinitely suspend your demo account and take other legal action against you if you commit any of the prohibited acts specified above.

Market Data

Non-Private Investor

The information you provided during the application process classifies you as a “Non-Private Investor” for market data purposes as you meet one of the conditions set out below:

  • You are not a natural person (meaning that you are not an individual).​
  • You access and use the market data and similar information for a commercial purpose or as a principal, officer, partner, employee or agent of any business or in connection with the professional management of third party assets and not in an individual and personal capacity for your own personal investment activities .
  • You are a financial institution or are registered with a securities agency, regulatory or self-regulatory body.
  • You are engaged in a financial service business and are employed as a financial adviser for the purposes of your agreement and trading activities with CMC Markets.
  • You engage in the business of accessing or aggregating the market data or similar information and redistributing or otherwise furnishing that information to any third parties.

Therefore, if you subscribe for any market data price feeds in respect of share CFDs you will be charged the Non-Private Investor rate. 1-Click trading terms of use

The 1-Click Trading feature allows you to open or close a CFD Margin Trade with just one click. Once a CFD Margin Trade size has been entered, clicking once on the buy or sell Price will send the Order straight through for processing.

You will not be asked to confirm the Order, it will be placed immediately (for more information on using 1-Click Trading, please refer our website).

External Dispute resolution

CMC Markets is a member of an external dispute resolution scheme operated by the Australian Financial Complaints Authority (AFCA). If you are not satisfied with the final response issued by CMC Markets, you may refer the matter to AFCA within 2 years of the date of the final response. AFCA provides fair and independent financial services complaint resolution that is free to all consumers.

From 1 July 2019 and for a 12-month period, AFCA will review eligible complaints dating back to the start of 2008. CMC Markets encourages customers to contact us directly in the first instance regarding any legacy complaints. Please refer to the AFCA website set out below for more information.

You may also choose to refer the matter to the Australian Securities and Investments Commission (‘ASIC’). ASIC may be contacted on their free call Infoline 1300 300 630.

If the complaint does not fall within the rules of AFCA, you may request us to submit the complaint to arbitration. If we agree to your request, the arbitration will be conducted in accordance with, and subject to, the Institute of Arbitrators and Mediators of Australia Expedited Commercial Arbitration Rules, and to the extent permitted under those rules the Arbitrator will be a person recommended by the New South Wales Chapter of the Institute of Arbitrators and Mediators of Australia.

If we do not agree to your request, you may not submit the dispute or difference to arbitration, although you may commence legal proceedings against us, in which case you agree to submit the dispute or difference to the courts of New South Wales, Australia.

To the maximum extent permitted by law, any dispute or difference whatsoever raised by you in connection with the FSG, and CMC Markets Stockbroking Terms and Conditions or other relevant documents (‘CMC Markets Documents‘) and our products must be dealt with in Australia as described above. The CMC Markets Documents are governed by the laws of New South Wales, Australia.

Design and distribution obligations (DDO)

Legislation has been introduced relating to the design and distribution of a wide range of financial products, including Exchange Traded Options (ETO) and Contracts for Difference (CFD) products that CMC Markets are offering to clients. The legislation aims to ensure that financial products are issued and distributed to an appropriate audience.
