Demo platform terms of use

These demo platform terms of use (“Terms”) are between you, and us, CMC Markets Germany GmbH (“CMC”) as appropriate. In these Terms we may refer to ourselves as “we”, “us”, “our”, “ours” or “ourselves”, as appropriate. Similarly, you may be referred to as “you”, “your “yours” or “yourself”, as appropriate in relation to these Terms.

CMC's demo account is a risk-free simulation of our trading platform. If you register for a demo account to trial CMC's trading platform, CMC grants you a personal, nonexclusive, revocable and non-transferable licence, to access and make personal and non-commercial use of the demo platform for the limited purpose of trialling CFD trading in accordance with these Terms. No other rights are granted in respect of the platform.

The demo platform is for demonstration purposes only and any trades you place do not create any rights or obligations between us and you. The information, content and functionality including pricing and order execution of the demo platform may differ from the live CMC trading platform. CMC does not warrant that any information, content or functionality of the demo platform will display, operate or otherwise perform in the same way as the live CMC trading platform. Please note that shares on a CFD demo trading account are available for a limited period due to exchange restrictions.

By opening a demo account with CMC, you confirm that you will not:

  • (a) copy, reproduce, or duplicate the platform or any content or data displayed on the website;

  • (b) authorise any other person to use the platform;

  • (c) link to the platform;

When you register as a client of CMC and utilise CMC's services, you will be asked to accept CMC's Terms of Business. These Terms of Business govern your legal relationship with CMC and CMC's liability to you in relation to the services to be provided under these Terms of Business.

1-Click Trading terms of use

The 1-Click Trading feature allows you to open or close a CFD Margin Trade with just one click. Once a CFD Margin Trade size has been entered, clicking once on the buy or sell Price will send the Order straight through for processing.

You will not be asked to confirm the Order, it will be placed immediately.

Before you can use 1-Click Trading on your Account, you will need to carefully read and then accept these terms on the platform.

These terms apply to you whether you are a client with a live account or a demo account user (although a demo account user has only “read-only” access to the Chart Forum). Summary of conflicts of interest policy

CMC’s conflicts of interest policy ("Policy") sets out the procedures and controls which help us identify, prevent and appropriately deal with conflicts of interest, whether actual, apparent or potential, in respect of our obligations to clients. CMC subjects all group companies, employees, appointed representatives, own agents, contractual partners and any other person directly or indirectly under CMC's control to these principles.

  • Objective

    The objective of the Policy is to ensure that conflicts of interest within CMC are identified, prevented and managed appropriately and, where necessary, disclosed in order to provide an appropriate service to clients in accordance with the rules and principles of the German Federal Financial Supervisory Authority ("BaFin").

  • Application

    This Policy applies to all of CMC’s BaFin regulated activities and activities in connection with or for the purposes of such regulated activities, including outsourced activities provided by a third party. All employees are obliged to adhere to these principles.

  • Identifying conflicts of interest

    CMC applies systems and procedures for the early detection of potential conflicts of interest. As soon as a conflict of interest is identified, measures are taken to resolve the problem appropriately. In assessing whether a conflict of interest has arisen, CMC will consider, amongst other things, whether:

    • CMC is likely to make a financial gain, or avoid a financial loss, at the expense of the client; or

    • an employee of CMC is likely to make a financial gain, or avoid a financial loss, at the expense of the client; or

    • a client of CMC is likely to make financial gain or avoid a financial loss at the expense of another client.

  • Managing Conflicts of Interest

    CMC has measures in place to recognise and resolve conflicts of interest. These include a range of organisational and administrative mechanisms aimed at safeguarding client interests and minimising potential conflicts.

    CMC has a catalogue of measures in place to mitigate conflicts of interest and control the movement of confidential data. A non-exhaustive list of some of the arrangements CMC adopts in order to manage conflicts of interest are:

    • Segregation of duties and supervision for persons engaged in different business activities including procedures for ensuring appropriate communication between business units;

    • Personal account dealing restrictions applicable to all staff and their associates, regardless of seniority;

    • Supervision of the sources of remuneration of relevant persons;

    • Protocols to ensure that no improper inducements are given or received and proper inducements are disclosed appropriately;

    • Gifts and personal benefits procedures including a gift register recording the solicitation, offer or receipt of certain benefits;

    • External directorship policy, including the requirement for all external directorships and outside business interests to be declared; and

    • The provision of training to directors and employees of CMC Markets on conflicts of interest management.

  • Conflicts disclosure

    If arrangements made by CMC are not or cannot be sufficient to ensure, with reasonable confidence, that risks of damage to the interests of a client will be prevented, CMC will disclose the general nature and/or source of conflicts of interest and the steps taken to mitigate those risk before undertaking business for/with the client.

Categorisation as a non-professional investor

To qualify as a private investor and in relation to your use of the information we provide, you must fulfil the following conditions:

  • You are not using our information in the course of your employment or for business purposes of any kind and only for your personal investments with us;

  • You are not registered with any securities commission, regulatory authority or self-regulatory organisation;

  • You are not a financial services provider and are not employed as a financial advisor;

  • You are not professionally engaged in the allocation and distribution or other provision of information.

Commissions and minimum commission

Calculation of commissions and minimum commissions

For reasons of transparency, we calculate the commission separately from our spread. Details of any commissions, if charged, can be found in the product list on the platform for each CMC product.

If commission is incurred on the execution of an order (when opening or closing a transaction on or after 30 June 2012), the relevant amount will be deducted from your cash in your account as soon as that order or transaction is executed. You are required to regularly monitor the trading account value of your trading account and ensure that there is sufficient cash to pay any commission in full.

Deposits and withdrawals from your trading account

How you can make a deposit

Please note that deposits can only be made from accounts in the name of the trading account holder. Deposits from third parties are not accepted and will be returned to the relevant bank account. Cash deposits are not possible.

You can fund your CMC Markets account in the following ways:

  • Card - via your trading account, either on the web-based platform or in the app
  • Online banking; connect directly to your online bank for fast, secure payments from your trading account, through the web-based platform or app
  • Bank transfer - via your online bank

Please enter your CMC account number as the reason for payment on the bank transfer form.

Please note that Sepa-transfers are not possible for deposits with CHF and USD. In this case, please use the conventional foreign bank transfer.

How you can make withdrawls

To withdraw money from your live account, simply click on the "Payments" icon and the "Withdrawals" tab. Enter the amount you wish to withdraw and click on "Withdraw money". The system will then process the payment for you. You can also contact our customer service team who can make the withdrawal for you. Please note that your reference account (= payout account) must be verified with us so that a payout can be made to this account, ie you yourself must be the account holder and you must prove your account ownership to CMC in a suitable form (e.g. bank confirmation).

Market data - non-private investor

According to the information in your application form, you are registered as a "non-private investor" in connection with price data because you fulfil one of the conditions listed below:

  • The account was not opened for personal use (ie the account was opened in connection with a trade or business or an investment fund with a professional asset manager);
  • You are currently registered or qualified as a professional securities dealer or investment adviser with a national or state securities exchange, regulatory authority, professional body, securities agency, trade association or professional organisation;
  • You are currently acting as an investment adviser;
  • You are using the account for a purpose other than managing your personal assets, such as a public trader or investing company funds.

Therefore, if you subscribe to price data for corporate CFDs, you will be charged the fees for non-private investors.

Revocation policy

  • Right to revocation:

    You can revoke your contractual declaration to participate in our platform and to open a trading account within 14 days without giving reasons in text form (e.g. letter, fax, email). The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfilment of our information obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB and our obligations pursuant to § 312e para. 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. Timely submission of the termination is sufficient to comply with the termination period. The termination is to be sent to:

  • Consequences of revocation:

    In the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) surrendered. If you are unable to return the goods or services received in full or in part or only in a deteriorated condition, you may have to compensate us for the loss in value. This may mean that you must nevertheless fulfil the contractual payment obligations for the period up to the revocation. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your revocation notice and for us when we receive it.

  • Special notes:

    Your right of revocation expires prematurely if the contract has been completely fulfilled by both parties at your express request before you have exercised your right of revocation.

    No right of revocation with regard to the conclusion of transactions:

    As CMC provides financial services as part of its platform, the price of which is subject to fluctuations on the financial market over which CMC has no influence and which may occur within the revocation period, you have no right of revocation with regard to the conclusion of transactions on the platform.
